Under O.C.G.A. § 16-5-40, a person commits kidnapping by abducting or stealing away another person without lawful authority and holding that person against their will. Three elements must be present: an illegal holding, an overmastering of the victim’s will, and asportation, meaning the movement of the victim from one place to another. However, if the movement was undertaken to avoid apprehension, Georgia courts treat it as independent asportation.
